I have a case that is currently in the solicitors hands and wondered if anyone could help with my case. I will keep the details very basic, but if anyone requires further info then please do let me know.

  • Approximately a year and four months ago I purchased the new range rover evoque.
  • I drove my car through a car wash one month after purchasing the car
  • 1 minute into the cleaning phase of the car wash, both rear doors opened ( I believe due to a fault with the door handles). I lent back to close the doors and unfortunately I sustained quite a bad injury.
  • Due to the car fault, I asked that JLR investigate, as I was concerned that if other evoque's had a similar fault to my car it could cause injury and was mainly concerned for drivers who have their kids in rear passanger seats.
  • JLR investigated and denied there are any issue with my car, so i drove the car back through a car wash and filmed the doors opening again!
  • This time my complaint was elevated to JLR global engineering team.
  • I today received a final response from JLR after a year of asking them to review and they confirmed that that there is no issue with my car and the accident is due to the car wash.
  • I have reviewed all accidents in the car wash over the past ten years and there have been no incidents involving range rover evoques. (however at the date the incident happened the range rover evoque was one of the first to enter the uk, so chances are no other evoque had used that car wash).

I wondered if anyone has heard of or had a similar experience? any technical advice? any solicitors you are aware of who specialise in this area.

Any help would really help.

Cheers

Dan

Welcome to the forum - perhaps you could post the video (via YouTube, just paste the link) so we can see the problem?

Was the Evoque damaged?

It's worth updating your forum profile with RRE year and spec so people can see what you have.

Thank you for your warm welcome. I'll try and upload a video this evening and update my forum profile as you mentioned.

By way of update, I have this minute just received an email stating an independent assessment of my car to be undertaken, due to the limited evidence provided my Jaguar Land Rover, who refuted my claim that there is a fault.

I’m sorry to hear you got injured and hopefully you have recovered or at least on the way! Sounds like the case is in the hands of the lawyers and I hope it goes in your favour!

On a side note that is interesting, my finance agreement specifically states not to use an automatic car wash, now I know why!!

Thank you. I believe from the research I have done, they note not to use a car wash due to 'micro scratches'.

Yes, I've never used an automatic car wash on any of my cars - but obviously people do.
Perhaps your month old Evoque was a company car or similar so you weren't too worried about the quality of the wash?

But that's not really the issue. I look forward to seeing the video.

Yes, there lies the other issue. Tesco have explained that if a car door is opened during a wash they have a safety mechanism that cuts off power, but this didn't happen the door was nearly taken off the hinges. You can see from the image the door isn't flush anymore

To be clear I presume this relates to the v2 Evoques with the “pop out” handles .............my Evoque (2017 normal handles) has used an IMO car wash on a regular basis for nearly 4 years without any issues. It has keyless locking / unlocking but the various car wash rollers have never resulted in the doors even being unlocked let alone opened......

Again just for clarity as you stating that the car wash both unlocked the door and physically opened the door ?

Edit: our posts crossed, the above pics confirm my queries .......wow just wow.......I presume the car was also locked so the car wash not only opened the doors but unlocked then prior to that (keyless entry ?)

The damage is typical of a RTA impact on an open door......I presume its been fixed now but if the hinges where not affected the frame can usually be simply bent back and if you lucky no actual damage.........

Probably not relevant to your case but the only issue I have ever had personally in a car wash was with a Vogue......it was only a few weeks old and the IMO rollers jammed on the roof and resulted in a fail safe stoppage of the wash......when we got the car out there was some very slight scratched on the roof.......the operator accepted liability on the spot and we settled on £50 of car wash vouchers......in effect it was my fault as I had forgotten to put the suspension in low mode which I new it required.......he readily offered the credit so I was not going to argue.......

Presumably you are trying to find out if other v2 evoque owners have experienced this or if is an isolated fault on your car ?

That is correct the V2 and I don't believe the car wash 'unlocked' the door but it did indeed open the door as per the above video.

I believe the handles were out at this point. But, I’m not 100% sure. The handles do have a pressure point and can open.

I know on ours if it’s locked you can manipulate the handle to the out position but they will not open any door, so has the car wash brushes got behind the unlocked/out handles and persuaded them to open 🧐

Presumably the washer pushed in the button on the handle which would have caused them to come out, and then the washer "caught" the handle which would have opened the door?

 ....pretty open and shut case I would say (sorry could not help myself)

The question is.....is it a fault just with your car or potential to all V2’s ?

But if the car was locked from auto locking as you move off or by interior lock button, and your in the car with smart key it shouldn’t open from outside by pressing keyless entry button on the handle, or am I missing something
